By downloading, installing, or using any application developed by MakeXYZ ("we", "us", or "our"), including but not limited to Sudoku, Flight Focus, EchoPaper, KiddoArt, Linguist, and BitZen (collectively, "the Apps"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Apps.

2. Description of Services

MakeXYZ develops and publishes mobile applications for iOS and macOS platforms. Our Apps include:

• Sudoku: A puzzle game with multiple difficulty levels
• Flight Focus: A Pomodoro timer with flight-themed experience
• EchoPaper: Voice-to-text notes with on-device AI
• KiddoArt: Drawing and storytelling app for children
• Linguist: Offline translation powered by on-device AI
• BitZen: Micro-meditation and mindfulness app

3. User Responsibilities

You are responsible for:

• Ensuring your device meets the system requirements for each App
• Using the Apps in compliance with all applicable laws and regulations
• Maintaining the security of your device and any data stored on it
• Backing up any data you wish to preserve before deleting an App

4. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we handle your data. In summary, most of our Apps process data locally on your device and do not collect personal information.

5. Intellectual Property

• The Apps and their original content, features, and functionality are owned by MakeXYZ and are protected by international copyright, trademark, and other intellectual property laws
• You retain ownership of all content you create using our Apps
• We claim no rights to your content and do not access or use it for any purpose

6. In-App Purchases and Subscriptions

Some Apps may offer in-app purchases or subscriptions. All purchases are processed through Apple's App Store and are subject to Apple's terms and conditions. Refund requests should be directed to Apple.

7. AI-Powered Features

Some of our Apps use artificial intelligence for features such as voice transcription and translation. These AI features are provided "as is" and may not be 100% accurate. AI-powered Apps are not intended to replace professional services (such as human translators or transcriptionists) for critical applications.

8. Health and Wellness Apps

Apps that offer mindfulness or wellness features (such as BitZen) are designed for general relaxation purposes only. They are not medical devices and are not intended to diagnose, treat, cure, or prevent any medical condition. If you have health concerns, please consult a qualified healthcare professional.

9. Children's Apps

Apps designed for children (such as KiddoArt) are intended for use by children under parental supervision. These Apps do not include social features, do not collect personal information, and do not display advertisements.

10. Limitations of Liability

THE APPS ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. IN NO EVENT SHALL MAKEXYZ BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APPS.

11. Modifications

We reserve the right to:

• Modify or discontinue any App at any time
• Update these Terms of Service
• Change features, functionality, or pricing

Continued use of our Apps after changes constitutes acceptance of the modified terms.

12. Termination

You may stop using our Apps at any time by deleting them from your device. We may terminate or suspend access to our Apps immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
